1. Scope and Provider

These General Terms and Conditions apply to all orders placed via the online shop of Bardi, Inna Bardakova, Heubergredder 14A, 22297 Hamburg, Germany ("we" or "us").

2. Conclusion of the Contract

The product presentations in the online shop do not constitute a legally binding offer, but rather a non-binding online catalog. By clicking the "Complete order" (or "Zahlungspflichtig bestellen") button, you are placing a binding order for the goods contained in the shopping cart. The purchase contract is only concluded when we accept your order by sending an order confirmation via email or by delivering the goods.

3. Statutory Right of Withdrawal

Consumers are entitled to a statutory right of withdrawal. Information on this can be found in our separate Cancellation Policy. In addition to the legal 14-day window, we grant you a voluntary return right of 30 days in total according to our Refund Policy.

4. Prices and Shipping Costs

The prices stated on the product pages include the statutory value-added tax (VAT) and other price components. Shipping costs are additional and will be clearly communicated during the checkout process. For deliveries to countries outside the EU, additional customs duties and fees may apply, which must be borne by the customer.

5. Delivery Conditions and Transfer of Risk

  1. Unless otherwise stated, the delivery time within Germany is 1–3 business days.

  2. Legal Notice on Shipping Risk: In accordance with § 475 Para. 2 BGB, as the merchant, we bear the shipping risk if you are a consumer. This means that if the goods are lost or damaged during transport, we are liable to the customer.

6. Payment Terms

Payment is made via the service providers offered during checkout (Shopify Payments). The purchase price is due immediately upon ordering.

7. Warranty (Liability for Defects)

The statutory warranty rights apply. Since our products are handmade candles, minor variations in color or surface structure do not constitute a defect. In the event of justified defects, you have the choice between supplementary performance (repair/replacement) or withdrawal from the contract.

8. Limitation of Liability

We have unlimited liability for intent and gross negligence. In the case of slight negligence, we are only liable for the breach of an essential contractual obligation (cardinal obligation). In this case, liability is limited to the foreseeable, contract-typical damage. This does not apply to injury to life, body, or health.

9. Retention of Title

The goods remain our property until full payment has been made.

10. Dispute Resolution

The European Commission provides a platform for Online Dispute Resolution (ODR): https://ec.europa.eu/consumers/odr/. We are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
